Abstract Quantum mechanics has seemed to defy all attempts to construe it realistically, but antirealism, like the many?worlds hypothesis, is even more difficult to accept. In order to give a realist construal of quantum mechanics, we need first to distinguish the objective and rational aspect of reality from the paradigmatic thing?like aspects of having determinate physical properties: quantum?mechanical entities may be real in the former sense though not in the latter. Anti?realist arguments are based on the difficulty of giving an (...) account of quantum?mechanical collapse and the apparent superluminal velocities involved. Objections to superluminal velocities on the score of the special theory of relativity are found not to be conclusive, and the price?there being some preferred frame of reference?to be acceptable. A sketch of a probabilistic account of quantum?mechanical collapse is offered, which makes the difference between the macro? and the micro?world a matter of degree rather than kind. If that, or some other, account proved acceptable, we could be quantum?mechanical realists, though quantum?mechanical reality would be very different from that of material objects in hardware shops. He argues that, although we might still wish to incarcerate such individuals to (...) prevent them inflicting further harm on others, we should be less enthusiastic to blame them for their actions.In many respects, I agree with much of Levy's treatise. I certainly do not regard ascriptions of blame as useful in my own work with this population. I believe that our goal should be to fully understand the nature of their emotional deficit to be able to treat it similarly to other researchers who work to treat other emotional disorders. To me, Levy's argument appears sound.However, I offer three considerations and raise questions within these considerations that might further the debate. First, not all rules involve care-based emotional responses to victims. As Levy notes, this is the origin of the moral/conventional distinction. The problem here is that we do consider someone responsible if they break a conventional transgression. The student talking in class is generally considered blameworthy for this action as long as they knew that the rule of not talking during the lesson applied to that classroom. Yet, there is no victim and no care-based emotional response. Here, the only thing necessary to ascribe blame and responsibility is that the individual knew that a rule exists. Given this holds for conventional transgressions, why must we necessarily make a special case, with respect to responsibility, for moral transgressions?I believe that Levy is fully aware of this concern. He specifically makes reference to moral responsibility and writes that:the kind and degree of wrongness, and therefore blame, which attaches to infringements of the rules [against double parking or line-jumping] is very different, and usually much less significant, than the kind and degree attaching to moral wrongs. For psychopaths, all offences are merely conventional, and therefore—from their point of view—none of them are all that serious.(2007, p. 132)But the danger here is that issues of blame and responsibility may become highly relativistic and hinge on the strength of the emotional reaction. This is a problem because, although we might judge someone as more blameworthy if he intentionally [End Page 149] runs over five people rather than one, do we really consider that there is a distinction in moral responsibility between these two cases? If not, might not responsibility relate to factual knowledge of the existence of the rule against the transgression rather than the emotional response to the transgression?Second, there is considerable debate regarding whether psychopathy represents a taxon or a continuum (e.g., Vasey et al. 2005; Edens et al. 2006). Assuming it does represent a continuum, then we have an additional concern. How little of an emotional response to the transgression reduces one's moral responsibility and blame? Is it only the very reduced (although usually not absent) levels of emotional response that are shown by individuals with psychopathy? Or should we consider moral responsibility and blame proportional to the level of the emotional response? If this latter option is adopted, then what should we do about individuals who show heightened emotional responses, for example, patients with specific anxiety disorders (Rauch, Shin, and Wright 2003)? There are already some data that inhibited children (a developmental precursor to some anxiety disorders; Kagan and Snidman 1999) show heightened conscience development (Asendorpf and Nunner-Winkler 1992). If such children commit moral transgressions, should we regard them as more morally responsible and more blameworthy than regular folks?Third, the issue of intention received little attention in this paper. I have been considered to show a similar lack of attention to intention in the past (Nichols 2002) and, moreover, in some respects the issue was of limited concern given Levy's main goals. Recent interest in emotion as the basis for moral development began with work involving individuals with psychopathic tendencies, and a recent paper with this population has allowed fresh insights (Glenn, Iyer, Graham, Koleva, & Haidt, 2009). Two main conclusions suggested by this paper are: (i) that systems involved in different forms of morality can be differentiated; and (ii) that systems involved in justice reasoning likely include amygdala and/or ventromedial prefrontal cortex, even if the specifics of their functional contribution to justice (...) development remain unidentified. Aim: Patients with advanced cancer need information about end-of-life treatment options in order to make informed decisions. Clinicians vary in the frequency with which they initiate these discussions.Patients and methods: As part of a long-term longitudinal study, patients with an expected 2-year survival of less than 50% who had advanced gastrointestinal or lung cancer or amyotrophic lateral sclerosis were interviewed. Each patient’s medical record was reviewed at enrollment and at 3 months for evidence of the discussion of patient wishes concerning (...) ventilator support, artificial nutrition and hydration , resuscitation and hospice care. A Kaplan–Meier analysis was also performed and 2-year survival calculated.Results: 60 cancer and 32 ALS patients were enrolled. ALS patients were more likely than cancer patients to have evidence of discussion about their wishes for ventilator support , ANH , DNR and hospice care . At 6 months, 91% of ALS patients were alive compared with 62% of cancer patients; at 2 years, 63% of ALS patients were alive compared with 23% of cancer patients .Conclusions: Cancer patients were less likely than ALS patients to have had documented advanced care planning discussions despite worse survival. This may reflect perceptions that ALS has a more predictable course, that advanced cancer has a greater number of treatment options, or differing views about hope. Nevertheless, cancer patients may be less adequately prepared for end-of-life decision-making. (shrink)

Decety (2011) considers the cognitive neuroscience of empathy and, in particular, his three-component model of empathic responding. His position is highly influential with its emotional awareness/understanding and emotional regulation components representing clear extensions of previous theorizing on empathy. In this brief commentary, I will critically consider the third of his components: affective arousal. In particular, I will consider the implications of the literature to the proposed computations, based on perception—action coupling, that underlie this component of his model. I will suggest (...) that perception—action coupling does not underlie affective arousal but rather that this is mediated by far more simple mechanisms of emotional arousal based on conditioning. Objective: To evaluate moral development as an indicator of the capacity to consent among two groups of patients from the Hospital de Clínicas in Porto Alegre, RS, Brazil.Method: Fifty-nine adolescents and 60 patients over 60 years of age participated in a cross-sectional study to assess moral development using Loevinger’s model of ego stages.Results: Age and moral development showed no association, with most participants in the two groups being in the conscientious phase.Conclusions: Age is probably not an adequate variable to measure (...) decision-making capacity, because questions of medical consent relate to participants’ own personal health. Decision-making capacity should be viewed as a continuous function. While the age of the person whose consent is needed should be considered, age alone, from a moral perspective, is not the main determinant of this capacity. (shrink)

Far from indicating a new superlative of holistic integrity, Whitehead prefers the always incomplete movement of all realities, which is the source of vitality for every new generation. This volume applies Whitehead's philosophy to superlatives-those valued concepts that limit and define our categories amid the flux of experience. The first half of this book probes the superlatives that have historically defined philosophical method in the West. These essays trace the adventures of concepts like substance, novelty, system, and truth. Ossified oppositions that define these superlatives are fractured, indicating new directions for growth. The essays in the second half of the book reflect on the influx, fragility, and impossibility of superlatives like care, tragedy, love, and loss in human experience, generating new matters of philosophical discourse. Superlatives abound. But Whitehead cautions us to attend to their multiplicity. The mutual immanence of events constantly generates new constellations of importance, and so superlatives, because they are contingent upon unstable modes of togetherness, cannot be taken for granted. The stock of natural law has risen in recent years. It is partly due to growing dissatisfaction with the elucidations offered by the legal positivists, and partly because sceptical arguments have lost their edge. In the heyday of logical positivism it was easy to say ``I don't understand what you mean by `right' . . .'' and break off discussion without more ado; but, as the bounds of unintelligibility increased and came to encompass almost the whole of human knowledge, an (...) inability to understand became not so much a boast as a confession. Many people may still be unclear about the metaphysical foundations of the moral sciences; but we are disinclined to doubt that they are serious disciplines, or to think that they need to be, or even could be, reconstructed without any moral element. Moreover, the events of this century have begun to penetrate the academic consciousness. Having witnessed the terrible tyrannies of the Nazis, the Communists and the Third World, we find it difficult to divorce our thinking about law from our thinking about morals. Although 'duty' is still an unfashionable word, people are constantly talking about the rights that are being denied them and the wrongs being inflicted on them. And these rights claimed and wrongs resented are grounded not on some existing legal enactment or a one-time social contract, but on the nature of man and the nature of the state, and are therefore, although very different from their mediaeval articulation, arguments of natural law. But it was very well established empirically, and had to be accepted. Similarly in contemporary quantum me- chanics we seem to have correlations between measurements that defy the Principle of Locality, but have to be accepted none the less.1 Although locality is a characteristic mark of causal con- nexion, it is not, as Hume supposed,2 (...) an essential one. Nor is it merely a uniformity we have found to hold for the most part|else we should feel little compunction in accepting that in some cases it happened not to hold. “Towards a Theory of Taxation” is a proper theme for an Englishman to take when giving a paper in America. After all it was from the absence of such a theory that the United States derived its existence. The Colonists felt strongly that there should be no taxation without representation, and George III was unable to explain to them convincingly why they should contribute to the cost of their defense. Since that time, understanding has not advanced much. In Britain we (...) still maintain the fiction that taxes are a voluntary gift to the Crown, and taxing statutes are given the Royal Assent with the special formula, “La Reine remercie ses bons sujets, accepte leur benevolence, et ainsi le veult” instead of the simple “La Reine le veult,” and in the United States taxes have regularly been levied on residents of the District of Columbia who until recently had no representation in Congress, and by the State of New York on those who worked but did not reside in the State, and so did not have a vote. Taxes are regularly levied, in America as elsewhere, on those who have no say on whether they should be levied or how they should be spent. I am taxed by the Federal Government on my American earnings and by state governments on my American spending, but I should be hard put to it to make out that it was unjust. Florida is wondering whether to follow California in taxing multinational corporations on their world-wide earnings. (shrink)

In saying ‘N knows that p’, where the supposed knowing is gained through rational reflection (the paradigm form of knowing, conceptually), I endorse N’s belief as rationally held, and hence correct (the ‘RhCB’ analysis). We understand this ‘hence’ not as ‘hence, infallibly’ but as ‘hence in fact’– a reliability reading, not implying infallibility (cf. the use of ‘hence’ to attribute non‐deterministic causation). The false appearance of inconsistency in our taking knowing to require an infallible guarantee of correctness while regularly attributing (...) knowledge where we lack an absolute guarantee arises from misreading of the ‘hence’ as implying infallibility, partly due to the mistaken assumption that ‘know’ functions purely descriptively. Though aware that rationality may occasionally fail to ensure correctness, we accept it as sufficing to yield knowledge wherever it does not fail – a consistent non‐infallibilist understanding of what knowing requires. R. and Philip Milton present the first critical edition of John Locke's Essay concerning Toleration, based on all extant manuscripts, and a number of other writings on law and politics composed between 1667 and 1683. Although Locke never published any of these works himself they are of very great interest for students of his intellectual development because they are markedly different from the early works he wrote while at Oxford and show him working out ideas that were to appear (...) in his mature political writings, the Two Treatises of Government and the Epistola de Tolerantia. With authoritative contextual guidance from the editors, this will be an invaluable resource for all historians of early modern philosophy, of legal, political, and religious thought, and of 17th century Britain. You had better look out.'' A blur of people, perhaps friends and supporters. Kindly, encouraging questions, some expected, some not. Balls asking to be hit for six; dropped catches---why had not I gone armed with a list of a dozen different ways in which Oxford was more up to date than other places? missed cues; fumbled answers; moments of caution; moments of over-confidence-- -``I have heard tell of a women's college where...'', biting my tongue just too late. In this article, Lucas maintains the falseness of Mechanism - the attempt to explain minds as machines - by means of Incompleteness Theorem of Gödel. Gödel’s theorem shows that in any system consistent and adequate for simple arithmetic there are formulae which cannot be proved in the system but that human minds can recognize as true; Lucas points out in his turn that Gödel’s theorem applies to machines because a machine is the concrete instantiation of a formal system: therefore, for (...) every machine consistent and able of doing simple arithmetic, there is a formula that it can’t produce as true but that we can see to be true, and so human minds and machines have to be different. Lucas considers as well in this article some possible objections to his argument: for any Gödelian formula we could, for instance, construct a machine able to produce it or we could put the Gödelian formulae that we had proved as axioms of a further machine. However - as Lucas underlines - for every of such machines we could again formulate another Gödelian formula, the Gödelian formula of these machines, that they are not able to proof but that we can recognize as true. More general arguments, such as the possibility to escape Gödelian argument by suggesting that Gödel’s theorem applies to consistent systems while we could be inconsistent ones, are moreover refuted by Lucas by maintaining that our inconsistency corresponds to occasional malfunctioning of a machine and not to his normal inconsistency; indeed, a inconsistent machine is characterized by producing any statement, on the contrary human being are selective and not disposed to assert anything. In La filosofia dell’arte, Giovanni Gentile assigned a prominent new role to the sentiments. This change struck some critics as a major departure from the earlier, classic accounts of actual idealism, in which Gentile argued that thought and language comprise the entirety of reality. Sentiments do not fit cleanly into a theory so narrowly concerned with thought and thinking. Their introduction, runs the objection, only compounds certain existing ambiguities in Gentile’s conception of the relation between mind and world. This article (...) describes and criticizes Gentile’s attempts to integrate feeling into actual idealism. It is argued that the appearance of feeling in his mature theory does not undermine but instead clarifies his views on the relation between thought and the act of thinking. Yet it also shows the strain under which idealist language was being put by the late 1920s.
